The accuracy and validity of the information and data contained in the Terms & Conditions were verified by BaG, at the precise time of their preparation.
The General Terms of Participation contained herein (hereinafter, the “Terms of Participation”) govern the obligations and rights of the legal or natural persons (hereinafter, the “Travelers”) wishing to purchase and participate in our Organized Tours, i.e. the visits, activities and/or excursions of any nature (hereinafter, the “Organized Tours” or the “Tours”) organized by the company with the corporate name “Be a Greek Travel Experiences” and the distinctive title “Be a Greek” (hereinafter, “BaG” or the “Company”).
Before purchasing any of our Organized Trips, please make sure that you have carefully read and fully understood these Terms of Participation. The purchase of any Organized Tour means that you unconditionally accept as a whole the following Terms of Participation as well as the specific Terms of the Organized Tour. For specific information (duration, destinations, prices, departure and return dates and times, the means of transportation, accommodation, visits etc.) relating to each organized trip, you will need to consult the running program and the relevant price list.
Some tours may have special terms and conditions that are provided at the time of quotation.
The Terms of Participation contain the general information as well as the rights and obligations of the Travelers and form an integral part of the Organized Tours. The specific terms and informations relating to the Tours (i.e. destinations, prices, days and times, etc.) are contained in the Details section of each Tour. It should be noted that, with respect to the contents and the information regarding each Organized Tour, the information and details of the Terms of Participation are of a general nature and they apply unless otherwise provided in the Description section of each Organized Tour.
The information, details and recommendations contained in the Terms of Participation were verified when this text was written as to their validity and accuracy. Itineraries in printed form and/or available on the Company’s website, including the pricelist applicable from time to time, are valid for the period referred to therein. It should be noted that these Terms of Participation are binding on both the Travelers and any members of their families or for whom the Travelers are responsible and the members of the groups they represent. The present constitutes the English translation of the Company’s Terms of Participation in Greek. In the event of any conflict or inconsistency between any section included in the Greek and the English translation, the provisions contained in the Greek document shall prevail.
Be a Greek is established in Athens, Greece, at 1 Bakou Georg., 11524 Nea Filothei and is registered with the Registry of Tourist Enterprises under No 0206E60000552201. The Company organizes and offers for sale Organized Tours and operates as an intermediary between the Travelers and the various providers of services it collaborates with (sites available for visits, museums, hotels, restaurants, service providers, transport companies etc.).
The Organized Tours are described on BaG’s website www.beagreek.com as well as in the Company’s brochures and they are valid for the period of time referred to therein and in accordance with the specific terms and conditions that are contained therein. The Organized Tours may also depend on conditions and factors beyond BaG’s control and they may, consequently, be modified at any time. In any such case, BaG shall make its best efforts to inform the Traveler in time in the most appropriate manner, i.e. through its website, by e-mail, telephone, and/or fax. Therefore, Travelers are required to make available to the Company their full contact details. Any changes, corrections and information related to the Organized Tours shall become binding from the time they are published or otherwise communicated and shall be applicable to all Travelers.
Participation in the Organized Tours is only allowed to persons of legal age in Greece, i.e. aged eighteen (18) or over and/or to under aged persons provided they are accompanied by at least one (1) of the person(s) that have parental or supervisory responsibility over them. The procedure for the participation in the Organized Tours is completed through the Company’s website, www.beagreek.com, provided that all the following are fulfilled:
The Traveler’s participation form regarding any Organized Tour should be submitted at the latest 15 days before the Organized Tour start date, unless otherwise provided in the Organized Tour. Especially for the Organized Tours that do not include accommodation and have a maximum duration of one day, the above period is no later than 7 (seven) days before the Organized Tour start date, unless otherwise provided in the Organized Tour.
Participation in an Organized Tour is only guaranteed upon full payment of the entire Price of the Tour Package and of any additional charges within 72 hours of the Price Quote received and, in any case, before the starting time of the Organized Tour. Especially for the Half Day and Full Day Organized Tours, participation is guaranteed upon full payment of the entire Price of the Organized Tour and of any additional charges at the time of the booking. Where payment is effected by credit card, the reservation may be automatically cancelled without any notice given to the Traveler, in the event that the credit card has no balance, had been denied or has expired. Participation shall be valid only where a receipt of full payment is issued, in which is indicated the particular Organized Tour, the corresponding time and date and all other identifying details.
The Company is not required to guarantee a ticket to any Traveler interested in participating in the Organized Tour, where all available tickets have been sold out in the meantime. The time limit provided for registering for any Organized Tour does not entail any liability for BaG regarding the availability of tickets.
Upon payment of the entire Price of the Organized Tour, in any manner whatsoever, the Traveler shall be deemed to have unconditionally accepted the Terms of Participation as well as any specific terms regarding all possible aspects of each Organized Tour. In any event, the Traveler contracting with BaG is required to inform the members the group of travelers he/she represents or his/her family members about the details of the Organized Tour and about these General Terms of Participation. Persons participating through third parties have the same obligations as the representative who registered them for the Organized Tour, while, upon request, BaG shall make available to them any relevant information.
All Prices are per person, unless otherwise stated, and they only include the services explicitly indicated. The price for participating in any Organized Tour (hereinafter, the “Price”) shall be indicated in BaG’s effective at that precise moment price list. Children from 0 to 12 years of age receive a 100% discount on the available adult fare, resulting in them participating in the Organized Tours free of charge, unless otherwise stated in the Description or Pricing section of each of the Organized Tours. Children from 12 to 18 years of age enjoy a 50% discount on the available adult fare.
We inform you that due to the various parameters affecting the determination of the Price, some of which are beyond BaG’s control and for which BaG may not be held liable in any manner whatsoever, the Company may readjust the Prices and inform the Travelers in any appropriate manner. Such changes may occur up to and no later than 30 days before the starting date of the corresponding Organized Tour. It should be noted that the Price does not include the cost of any services indicated in the Tour Packages and offered/provided by any third natural or legal parties (for example shops, restaurants and bars, museums, archaeological/cultural or any other site of similar nature etc.). The cost of the above services shall be directly paid by the Traveler, in addition to the Price, unless expressed otherwise in the specific Organized Tour Description or Pricing section.
All Travelers are required, for the duration of the Organized Tour, to have and make available upon request to BaG’s guides or State Representatives or to any interested third person their National Identity Card (ID Card), Passport or other officially recognized public identification document. Identification documents for any under aged persons must explicitly state their date of birth. Travelers are required at all times to behave in a socially acceptable manner and be understanding towards other Travelers as well as other operators participating in the organization of the Tour Packages. In particular, for the duration of the Tours, Travelers are required to be extremely careful with the artifacts and objects exhibited and other objects found in the sites visited, as well as respect and fully comply with all the specific requirements (i.e. dress codes, height or health limitations etc.) applicable thereto.
All Travelers are required to fully respect the Organized Tour’s itinerary, the instructions of BaG’s guides or representatives and to arrive on time at the meeting places for the various itinerary services to be carried out (trips, guided visits, excursions, courses etc.). All Travelers or group members should be at the prearranged meeting point at least 30 minutes before departure. We particularly draw the attention of Travelers from other regions and countries to check beforehand how to reach the meeting place so as not to be affected by any delays and/or strikes of the local means of transportation. Travelers shall supervise all under aged persons continuously during the entire Organized Tour as to their safety and behavior and shall be responsible for the actions of all the under aged persons that they accompany. The Travelers are required to fully compensate the Company for any damage (including any potential loss of profits) sustained by the Company due to their acts or omissions with regard to any part of the Organized Tour.
In order to organize the Organized Tours, BaG will use third parties that it does not directly control or supervise. BaG does not own the transportation means to be used and may not be held liable, in any manner whatsoever, for the operation of third party transportation means. BaG’s role is purely that of an intermediary for the services provided to the Travelers and therefore, its liability will be strictly limited to omissions and organization deficiencies attributable to willful misconduct or gross negligence. The Company is required to coordinate and perform in the best possible manner the Organized Tour by acting as an intermediary between the Travelers and any third party providing the service and it shall make its best efforts to meet the Travelers’ expectations. In any case, BaG cannot exercise direct control over third parties and it cannot, therefore, be held liable for any wrongdoings and omissions by any third parties unrelated to the provision of the services, and by any of its collaborators thereof, as well as for any kind of emergency such as changes, delays or cancellations in the itineraries of various transportation means (airplanes, boats, buses, trains, etc.) due to a restriction imposed to certain areas because of strikes, manifestations or any other possible cause. It should be noted that BaG is not in a position to foresee or influence situations which are beyond its control and which may result in the cancellation of any Organized Tour or of specific services, activities and visits, included in the Organized Tour, or in damage due to the non-performance or the uncompleted performance of the agreed services referred to in the Organized Tour. Such cases may include, for example: weather conditions, strikes, accidents, earthquakes, fires, or any other kind of emergency.
In all the above cases, BaG shall make its best efforts to ensure the continuation and completion of the Organized Tour, without, however, being held liable in any manner whatsoever and without bearing any costs, which will be borne exclusively by the Travelers, as if they were faced with such emergencies on their own. Furthermore, in such cases, BaG may not be held liable to compensate any damage sustained by any Traveler due to the above causes. BaG shall make its best efforts to assist the Travelers in any manner whatsoever, but this does not make BaG liable or responsible for covering any relevant extra costs, which shall be covered, as in the cases of force majeure, by the Travelers themselves. During the performance of any Tour Package, any complaints by the Travelers should be immediately reported on the spot to BaG’s representative (or, in the absence of any such representative, to BaG directly). Where the issue reported cannot be solved on the spot, the Traveler shall submit such complaint to BaG in writing within 5 (five) business days from the Organized Tour’s completion date, together with any documents or other supporting evidence. Upon expiration of the above deadline, BaG shall not be required to respond to any claim. In any case or event, any compensation for failure to provide any type of service or any Tour may not exceed the value of each service or the Organized Tour itself, respectively.
The Company may, for a certain period of time or for a limited number of tickets, offer for sale tickets for specific Organized Tours at more convenient prices, under special conditions or special cancellation terms. Any such offer by BaG does not entitle other Travelers to claim a similar discount or to cancel their participation without paying the Cancellation Fee foreseen. BaG may offer special Organized Tours at special or discount prices and under special Terms & Conditions. In such cases, registration to participate in the Organized Tour may require full payment in advance of the Organized Tour’s Price and provide for different cancellation periods or other conditions that may be less favorable to the Traveler than the ordinary conditions. In case of particular Organized Tours or special offers, cancellation or any change may also not be possible and cancellation may result in payment of the entire Cancellation Fee, as specifically described in each and every case in the Organized Tour’s Description or Pricing section.
The Company will make its best efforts to fully respect the Organized Tour’s itinerary as indicated in the Description section of each Organized Tour. It may, however, make any kind of changes to the itinerary, to the extent that the Company considers this to be appropriate in order to overcome any technical problems or unforeseen difficulties or even in respect with the Traveler’s requests and needs. Provided that the changes made to the itinerary described have been communicated in any clearly understood manner to the Traveler, BaG shall not be bound by the description of the Organized Tour’s itinerary. In some cases, particular Organized Tours may require a minimum number of participants in order to be carried out. BaG may cancel any Organized Tours, where the quota of participation is regarded to be insufficient, or for any other reason which makes, at BaG’s discretion, the provided presentation and global quality of the Organized Tour unacceptable. In such a case, BaG shall inform the Travelers about the cancellation of the Organized Tour in any appropriate manner and furthermore, the Company’s responsibility is limited only and exclusively to refunding the funds it has already received.
Before, during and after all types of Organized Tours, Events, Tailor Made Vacations and/or any other type of Experiences, the Company may photograph, record on video or broadcast a part or even the whole Organized Tour, Event, Tailor Made Vacation and/or any other type of Experience. The photographs, video recordings or broadcasts of any kind are property of Be a Greek alone and none of the Participants will have any type of rights, partial or total, over the commercial or of all other types of use of them. If a Participant desires not to appear in photographs, video recordings or broadcasts of any kind of Be a Greek, he/she must communicate to the Company his/her will in writing, up to and not after seven (7) days before the Organized Tour, Event, Tailor Made Vacation and/or any other type of Experience takes place. The time, way and type of use of the aforementioned photographs, video recordings or broadcasts of any kind remains at Be a Greek’s discretion. Be a Greek will always take all measures necessary to protect the privacy of minors and will never use photographs, video recordings or broadcasts of them of any kind without the consent of the parents or the person legally responsible for them.
The Organized Tour’s itinerary may include additional services offered in collaboration with third parties. The prices for such optional services offered are determined by the third parties offering such services and may vary from time to time. The Company shall not be liable for any of these optional services or activities, which are not organized by BaG but are only proposed by it.
When a Traveler misses the Organized Tour, in whole or in part, and such miss is due to his/her own delays and inconsistencies or negligence, or to any other reasons concerning him/her personally, BaG shall not be held liable and the Traveler may not claim any kind of refund or other compensation from BaG for the Organized Tour or the specific service missed. In such a case, any expenses incurred by the Traveler to reunite with the group shall be borne exclusively by him/her. Similarly, when the Traveler decides to interrupt the Organized Tours and to leave the group, even on grounds of force majeure, he/she shall not be entitled to any kind of compensation and BaG may not be held liable, and the Traveler shall be responsible for his/her leaving the group and any relevant costs shall be borne exclusively by him/her. Where the Traveler is not able, for reasons concerning him/her personally, to participate in the Organized Tour, where he/she has make a reservation, he/she may either assign his/her reservation to any other person, provided that this person meets the conditions for participating in the particular Organized Tour, or change the selected Organized Tour’s date, provided that he/she informs the Company about this assignment at the latest five (5) business days before the Organized Tour’s starting date. In case of assignment of an Organized Tour discounted according to clauses in Chapter 5 of the present Terms & Conditions to an assignee that does not qualify for the application of the discount or qualifies for the application of smaller discount, the assignor and the assignee will be jointly and severally liable for the payment of the amount of the difference and such payment shall be the precondition for the assignment to be valid. The Company shall not be held liable for the return of the amount of any difference in case the assignee qualifies for a discount or a bigger discount than the one already applied. BaG may not be held liable where assignment of the participation is not possible. The ensuing mandatory cancellation of the reservation shall be effected in line with the cancellation terms provided herein.
BaG has stipulated a group insurance policy for professional third-party liability (AXA Insurance – No 1491304), covering any cases of liability towards Travelers arising from non-performance or incomplete performance of BaG’s obligations, as described in the Organized Tours. The insurance policy also covers insolvency and bankruptcy as well as the obligation to refund any amounts paid by Travelers. The insurance policy number and the details of the insurance company are indicated in the agreement signed between BaG and the Traveler. A copy of such insurance policy may be handed to the Traveler upon request. Since the coverage amount offered by group insurance policies is marginal, specific and limited, BaG strongly suggests to those wishing to stipulate an insurance policy for larger amounts, for risks of loss of life, sickness, accident and loss or destruction of luggage, property and other valuables not covered by the group insurance policy, to stipulate an individual insurance policy for any amount they consider to be the appropriate one.
For all international trips, a latest type passport is required issued from 2006 onwards. Countries in the Schengen Area also accept new National ID Cards. The Company strongly recommends that you have a passport valid at least until a week after your scheduled return date. In any event, Travelers should contact, on their own initiative and action, the Consular Authorities in their country to check whether they need a Visa or any other document to enter Greece, or for any intermediate countries they may stop in transit before or after visiting Greece, as well as for returning in their country of origin. In case the Traveler, for any reason whatsoever, does not succeed in obtaining in time all the necessary travel documents and/or visas, this does not justify cancelling the Traveler’s participation in an Organized Tour of any kind without paying the predicted Cancellation Fee. All Travelers are responsible for the issuing and the validity of all their travel documents (Passport, National ID, etc.) and BaG shall have no liability in this matter. Particular attention should be paid to under aged Travelers who should imperatively have all the required travel documents (passport, Health Insurance Card etc.). Foreign Travelers should have with them the “European Health Insurance Card” issued by their insurance organization. The Travelers are exclusively responsible for contacting the competent local Health Authorities to obtain any kind of official and valid information, or their doctors, indicating any specific local conditions, and BaG shall have no liability in this respect.
In order to organize and carry out the Organized Tours and offer the proposed services, BaG pays in advance considerable amounts of money and undertakes specific compensation obligations in the event of cancellations, either in whole or in part. Cancellations shall be effected only by giving notice to the Company in writing and are subject to the following cancellation charges depending on the date of cancellation:
In case of a no-show, the total amount of the Organized Tour Price shall be charged per person. For the Company and its representatives, a no-show is considered the non-arrival of all or any of the Travelers participating in the Organized Tour at the pre-arranged starting site and at the pre-arranged time of the Organized Tour. It is noted that under no circumstance the aforementioned Cancellation Fees shall limit the Company’s right to claim any and further compensation for any direct or indirect damages suffered due to the cancellation itself (including any loss of profit and costs/expenses of any nature). In the event of cancellation of an Organized Tour by the Traveler, BaG may charge the Traveler’s credit card with the predicted amount of the cancellation fee (in accordance with the Cancellation Policy applicable to the particular reservation) without requiring the credit card holder’s approval or signature.
The Travelers shall be exclusively responsible for taking care for their luggage, regardless of the presence or not of any BaG representatives and the Company shall not be liable for any loss or damage to the luggage and the contents thereof.
The Company undertakes that it will not sell or convey in any way, license or disclose personal data of customers/users of the website to third parties without their concession, except for any third parties and service providers directly related to the implementation and execution of the Organized Tours and in cases dictated by the applicable law. BaG may process a part or all of the data sent by the customers/users for statistical purposes and for the improvement of the services and information provided. The Travelers accept and give their consent to the processing of their personal data contained in the BaG website pages, as well as to the transmission of those data to third parties and service providers related only to the implementation and successful completion of the Organized Tour. Personal data entered by the customers/users of the BaG website will be exclusively used to ensure the operations and provisions of services and may not be used by anyone, without complying with the provisions of Law 2472/97 (Protection of Individuals with regard to the Processing of Personal Data). BaG does not control and shall have no responsibility for the protection of personal data by other websites and pages referred to via links (hyperlinks) or promotional advertising (banners) that may be present at the BaG website. For any problem that occurs during their visit, customers/users must refer directly to the respective administrators of these websites.
In line with BaG’s philosophy, an attempt shall always be made to amicably settle any dispute that may arise related to the interpretation of these Terms & Conditions as well as any other issue that may arise from the participation in the Organized Tours. The agreement between the Company and the Traveler shall always be governed by the Greek law. In any case where an amicable settlement of the dispute is not possible, the Judicial Authorities of Athens shall be the competent Authorities for its final resolution.
